Abstract

1. In the era of big data, a three-dimensional structure of privacy, competition, and consumers is forming around data, and there is a possibility that privacy, competition law, and consumer policy will converge. However, there are still theoretical challenges in explaining the relationship between them, as evidenced by the recent Facebook cases in Germany and Europe. There are specific points of contact between them, but they are not yet clearly identified. 2. The link between privacy and competition law is consumer welfare. The problem for the German Federal Cartel Office and the ECJ is that consumer welfare is not only determined by price, but also by other factors such as quality and consumer choice. This means that consumer welfare should be evaluated not only according to the price/quality criteria commonly used in competition law, but also according to other dimensions such as violations of privacy law. A good example of this approach is the regular opinion of the European Data Protection Supervisor (EDPS). 3. Integrating privacy issues into the competition law analytical framework is not the answer, and it is questionable whether it is desirable to create a field of law called data (privacy) competition law. There is a risk that competition law could become a surrogate for other areas of law, such as consumer law, where enforcement is absent or insufficient. Furthermore, data privacy is a fundamental right under the Constitution and should not be reduced to the economic value of consumer interests under the Fair Trade Act. 4. In conclusion, a market-dominant platform provider’s violation of the Personal Information Protection Act does not naturally constitute a violation of the Fair Trade Act, nor does a violation of consumer protection laws directly lead to a violation of the Korea Monopoly Regulation and Fair Trade Act. This interpretation does not allow the antitrust laws to be extended to values unrelated to competition.
