Abstract
The EU Commission has been operating a "cooperation procedure" for non-cartel case, starting with the ARA case decided in September 2016. The cooperation procedure means that if the examinee conducts certain cooperative actions such as acknowledging the infringement and its liability and giving up certain procedural rights to the EU Commission, the EU Commission will reduce fines at a certain rate as compensation. Although the EU Commission does not have any explicit codification for the procedure, it should be noted that the procedure is a definite legal system because the EU Commission has applied the procedure in ten cases over the last three years. This procedure has great importance for Korean companies operating in the EU. Moreover, it can provide some implications for the domestic competition policies regarding the cooperation in investigation. However, it seems that only few researches were implemented on the cooperation procedure in Korea. In this article, the main purpose and the legal basis of the procedure, and the differences from other legal systems were briefly reviewed. And this article outlined how the procedure proceeds in detail by reviewing relevant documents. And then, the determinant factors for requirements of cooperation and reduction rate of fine, which are the core of this procedure were reviewed through analyzing main cases which the procedure was actually applied. Finally, some implications of the procedure for Korean companies and KFTC’s competition policy were also examined.
