태국 경쟁법의 변화 과정과 현행 「거래경쟁법」의 주요 내용

태국 「거래경쟁법」은 1979년 제정된 「가격고정 및 반독점법」을 대체하면서 1999년 2월 10일 제정되어 4월 30일 공포되었다. 이후 20년 가까이 별다른 변화 없이 비효율적이라는 비판에 직면하며 유지되어 오다가 2017년 법 개정이 이루어지면서 같은 해 10월 5일 시행되어 현재에 이르고 있다. 대부분의 ASEAN 회원국과 마찬가지로 정부 주도의 산업화 내지 경제발전을 위한 산업정책적 요구가 경쟁법ㆍ정책적 고려보다 여전히 중요한 의미를 가지는 국내적 상황에도 불구하고 외부적 요인에 의하여 우선은 경쟁법을 도입해야만 하는 등, 태국 경쟁법 역시 이러한 국ㆍ내외적 상황에 직면하면서 변화와 발전을 이루어 왔다. 특히, 「거래경쟁법」은 2017년 개정으로 보다 체계화 된 경쟁규범의 모습을 갖추게 되었으며, 집행기관으로서 거래경쟁위원회(TCC)의 독립성 확보와 고시 등 하위법령 마련을 통하여 실효적 법집행의 기반을 확보하게 되었다. 다만, 태국의 경우 아직까지는 경쟁법 집행사례가 축적되거나 잘 알려지지도 않은 만큼 해외사업자의 태국 시장진출 내지 안정적 사업활동에 있어서 요구되는 경쟁법 해석ㆍ집행의 예측가능성이 충분히 확보되었다고 보기는 어려운 상황이다. 이에 2017년 개정 이후 시행 중인 「거래경쟁법」의 실체ㆍ절차법 규정 전반을 구체적으로 살펴보고, 향후 태국 경쟁법의 변화와 집행 동향, 특성에 관한 연구를 지속해 나아가는 것은 무엇보다 중요할 것이다.
Abstract
Thailand’s ‘Trade Competition Act’ was enacted on February 10, 1999 and promulgated on April 30, 1999, replacing the ‘Price Fixation and Antitrust Act’ enacted in 1979. The Act had been maintained for nearly twenty years without a notable change and was criticised for being ineffective. As a result, the Act was amended in 2017 and came to effect on 5, October of the same year. Like the other competition laws of most ASEAN member countries, Thailand’s Trade Competition Act has undergone changes and developments under both domestic situations and international circumstances. Domestically, government-led industrialization or economic development was considered as more important than competition law or policy considerations. Externally, Thailand had to introduce competition law hastily. In particular, the Trade Competition Act was revised in 2017 to contain a more systemized competition norm, and to provide for the independence of the Trade and Competition Committee (TCC) as the enforcement agency. The Act also established the basis for effective law enforcement by preparing sub-laws including the public announcements. It is difficult, however, to say that the predictability of the interpretation and enforcement of the competition law required for overseas business entry into the Thai market or business activity is sufficiently secured, as only few competition law enforcement cases have been accumulated. In this regard, continuous research on changes, enforcement trends and characteristics of Thailand's competition law will be of utmost importance.
