1990년 이래로 민주주의 이행기에 있는 나라는 물론이거니와 성공적인 민주화 과정을 겪은 나라에서도 과거청산의 문제가 새롭게 주목받고 있다. 그러나 과거청산의 전개과정은 각 국가별로 다양한 방식과 수준으로 전개되어 왔다. 이러한 맥락에서 본 연구는 나치 이후 가장 잔혹한 제노사이드라고 할 수 있는 크메르루즈 제노사이드에 대한 과거청산의 양상을 살펴보았다. 연구의 결과 캄보디아는 정부가 유엔 및 국제사회와의 외교적 협상을 통해서 재판소 설립과 운영에 성공하여 5명의 기소자를 법정에 세웠지만, 역설적이게도 크메르루즈의 범죄에 관한 과거문제는 청산되기보다는 오히려 과거를 묻어두기는 것으로 귀결되고 있다는 점을 발견하였다. 이러한 한계에도 불구하고 과거청산의 주요 행위자인 캄보디아 정부는 크메르루즈 재판을 국제사회의 이슈로 부각시킴으로써 의도한 정치적 ․ 외교적 목적을 달성한 것으로 평가된다. 이에 본 논문은 크메르루즈 재판이 과거청산의 맥락에서 ‘미완의 작업’으로 남게 되는 과정의 정치동학에 대해서 살펴보고 재판이 오히려 ‘과거묻어두기’로 귀결되게 되는 구조적 요인을 캄보디아 내부의 맥락-타율적 민주화의 한계와 취약한 시민사회의 딜레마-을 중심으로 분석하였다.
Abstract
Since 1990s, there are a new attention of liquidation among the countries that are in the democratic transition and achieve democratization successfully in the world. However the phase or way of liquidation is very various according to the each countries. In this context, this article focuses on Khmer Rouge that showed the highest brutality except Nazis and analyzes the political dynamics of Cambodia's liquidation in the Khmer Rouge Trial process. I found out that although Cambodia started a kind of negotiation with UN for establishment of Khmer Rouge Tribunal and finally proceeds the trial, Cambodia tried to bury the past, not liquidation. It means that Cambodia government as a main actor of liquidation is making use of Khmer Rouge Trial as a strategy of political and diplomatic negotiations. So this article analyzes the structural factors based on the Cambodia's context -heteronomous democratization, weak civil society and dilemma- that can explain why Khmer Rouge Trial come to conclusion incompletion.
