남해 다랭이 논의 협력적 관리원칙 연구: 오스트롬의 공유재 관리원칙을 중심으로

본 연구는 공유재에 대한 협력적 관리원칙의 유용성을 검증하기 위해 공유재적 특성을 지닌 경남 남해군 남면 다랭이 논과 경관을 연구대상으로 삼았다. 명확하게 정의된 물리적 영역의 경우 상위법에는 존재하였으나 자치규약에는 존재하지 않았다. 명확하게 정의된 사회적 영역, 참여적 의사결정 구조, 감시활동, 점증적 제재조치, 갈등해결 장치, 중층의 정합성 있는 조직은 상위법에는 존재하지 않았으나 자치규약에서는 발견되었다. 사용 및 제공 규칙의 현지조건과의 부합성은 상위법 및 자치규약 모두에서 발견되지 않아 다랭이 논 관리에서 가장 취약한 관리원칙으로 확인되었다. 본사례연구에서 밝혀진 공유재적 특성을 가진 농어촌자원의 협력적 관리원칙은 농어촌자원의 효율적 이용과 관리에 새로운 가능성을 제시하고 있다. 그리고 공유재를 활용한 자원 개발사업의 공익적가치를 높여주는 새로운 시도로 평가될 수 있을 것이다.
Abstract
This study was conducted for the terraced paddy field and landscape of Nam-myeon, Namhae-gun, Gyeongnam, which has all the characteristics of common pool resources to verify the usefulness of the cooperative management principle of common pool resources. Clearly defined physical domain was present in the upper law, but not in the autonomous rules. Clearly defined social domain, participatory decision making structure, incremental sanctions, mechanisms for conflict resolution and rapid decisionmaking organizations existed in the upper law, but not in autonomous rules. Compliance with the local conditions of the use and provision rules was not found in either upper law or autonomous rules, confirming that it is the weakest management principle in the management of terraced paddy field. Cooperative management principle of farming and fishing resources, which have characteristics of common pool resources revealed in this case study, present new possibilities in the efficient use and management. of farming and fishing resources. This can be evaluated as a new attempt to increase the public value of resource development projects using common pool resources. This study was conducted for the terraced paddy field and landscape of Nam-myeon, Namhae-gun, Gyeongnam, which has the characteristics of common pool resources.
