현대사회에서 스포츠는 삶의 한 부분이 되었다. 사람들은 건강을 위하여 또는 삶 자체를 위하여 스포츠를 생활화하고 있다. 우리나라는 세계적인 스포츠경기대회를 여러 번 개최하였고, 2018년 2월 평창에서 동계올림픽을 개최한다. 이렇게 스포츠는 오늘날 국제화되어 많은 국가에서 스포츠경기대회가 열고 대부분의 국가는 국제경기대회에 참가하고 있다. 이미 세계적으로 조직된 스포츠단체들과 빈번하게 개최되는 스포츠경기, 건강과 레저생활을 위한 운동이나 스포츠생활은 스포츠를 인간의 삶에서 분리할 수 없음을 보여준다. 그런데 모든 사람이 스포츠를 보고 참가하며 즐기는 것은 아니다. 스포츠의 규모가 커지면서 스포츠는 경제적으로도 중요한 대상이 되었다. 스포츠산업은 보고 즐기는 스포츠분야에서 뿐만 아니라 스포츠용품이나 스포츠시설 등에서 급속하게 성장하고 있다. 국제사회에서는 이미 오래 전부터 스포츠를 하나의 인권으로 인정하고 있다. 이는 스포츠가 문화의 한 부분으로 기능하고 있기 때문이다. 그런 점에서 유럽연합은 스포츠헌장을 제정하였고, 조약을 통하여 스포츠인의 권리를 하나의 기본권으로 인정하고 있다. 우리나라에서도 스포츠권을 헌법에 규정하여 기본권으로 인정해야 한다는 주장이 계속되고 있다. 이제 스포츠에 관한 권리는 인권으로서 국제사회에서 인정되고 있다. 우리나라도 국제적 경향에 맞추어 스포츠기본권의 명문화를 적극적으로 추진해야 한다.
Abstract
Sports has become an essential part of daily lives since people participate in sports everyday for health or other reasons. It has been globalized as well as many countries host sports events and participate in those. Korea has hosted global sports events several times as well, and it will host the Pyongchang Winter Olympics in February 2018. However, not everyone participates in sports and enjoys it. With the increasing demand for sports, the sports industry which includes not only sports events but also sports equipment supply and sports facilities has grown to have a big portion in the economy. The international society has recognized the right to participate in sports as one of the important social human rights, since sports is part of the culture. The European Union adopted a Sports Constitution, and has recognized sports as one of the basic rights. There has been voices in Korea as well which calls for the Constitution to include sports in the basic rights. Considering the importance of sports and the trend of the international society, Korea should also consider stipulating sports in the legal system.
