본 연구의 목적은 국내 스포츠계의 지도자 채용과정에서 성차별적 관행이 존재한다는 가정 하에 이러한 관행을 개선하기 위하여 법정책적 대응방안을 제시하는데 있다. 그 대안으로는 첫째, Title IX의 1681조 (b)에서 명시하고 있는 ‘성비의 균형’은 양성평등을 실현할 수 있는 구체적인 방안이라고 생각된다. 또한 여성 스포츠팀에서 남녀 지원자가 자격이 동등할 경우 반드시 여성 지도자를 채용하는 것과 같은 ‘적극적 우대조치’의 도입이 필요하다고 본다. 둘째, NFL의 Rooney Rule과 같은 정책이 필요하다고 본다. 셋째, 스포츠 지도자의 채용 정책이 전반적으로 수정되어야 한다. 예를 들어, 공개채용의 의무화, 스포츠 지도자 직무의 표준화, 공개채용 내용의 명확성, 공개채용 문서 작성 안내서, 탈락 이유 공개의 원칙 등이다. 넷째, 여성 스포츠인이 자립할 수 있도록 주기적인 교육이 필요하다. 다섯째, 여성 스포츠인으로 구성된 이익단체의 세력화가 필요하다. 여섯째, 여성 스포츠인의 인권을 보호하고 입장을 대변하는 전문 법률단이 필요하다.
Abstract
The purpose of this study was to suggest institutional plans for hiring of athletic coach based on gender equity. The suggested plans were as follows. First, 'balance of sex ratio' prescribed in Title IX, 1681(b) is very specific provision that Korea can apply and achieve the gender equity. Korea also can adopt actively the policy of "Affirmative Action." That can be used when if qualification between male and female applicants applying woman's sport team is equal, woman applicant should be hired in terms of Affirmative Action. Second, Rooney Rule of NFL is good example we can apply for achieving gender equity in coach hiring. Third, coach hiring policies should be overall updated and amended into such as opening public invitation of applications for coaching job, job standardization, clear contents of job duty, guideline about job opening letter, and open to rejected applicant about the reason. Fourth, periodical education should be provided for sport women to help their self-sustained growth. Fifth, interested group consisted of sport women needs and increases in power. Sixth, a legal advising group which is protecting human rights of sport women and speaking for their voices will be necessarily needed.
