Abstract
Sports were not explicitly mentioned in EU and EC treaties before the Lisbon Treaty came into force in December 2009. However, sports as an economic activity are subject to the application of EU laws such as the principles of market freedom and competition law. In other words, certain aspects of sports intersect with EU law when they relate to economic factors such as broadcasting rights, competition law, and the free movement of athletes and professionals. As demonstrated by the Bosman ruling, when sports are associated with commercial or labor activities, the EU has intervened directly in sports. Additionally, EU competition law plays a role in regulating specific aspects of sports, particularly in preventing anti-competitive practices. However, the application of EU law to sports necessitates consideration of the specificity of sports, its voluntary structure, and the social and educational functions it serves. In cases heard by the EU Court of Justice concerning sports, rules regarding the 'pure benefit of sports' fall outside the scope of EU treaties, but rules concerning the free movement of workers, the provision of services, and competition restrictions fall under EU treaty jurisdiction. This underscores the direction of EU policy towards the formation of the European single market, which emphasizes the free movement of people and goods and competition, a direction evident even in sports policy. Therefore, it can be concluded that sports today do not fall outside the scope of EU law; rather, sports as an economic activity are subject to the fundamental freedoms of EU law and competition law. This study provides an overview of EU law regarding sports while also examining the impact of EU treaties on sports law through cases directly handled by the EU Court of Justice. It also explores how the specificity of sports based on its social and educational functions, emphasized by EU sports norms in judgments applying EU treaties, has been considered.
