본 연구는 2015년도 독일연방행정법원의 업무현황 및 주요 판례를 소개하고 분석함으로 한국과 독일 행정법의 비교법적 연구에 기여하는 것을목적으로 한다. 선정된 판례는 독일연방행정법원의 2015년도 판례로, 외국인의 장기거주권한, 더블린 규약-II의 관할규정과 그 법적 성격에 대한 상반된 판결, 연방의회의 학술업무자료에 대한 정보공개법상 접근권, 양계장시설 인근 주민에 대한 사전보호적 조치, 공무 이외에 아동음란물을 소지한경찰공무원의 징계처분에 대한 판례가 분석되었다.
Abstract
This article is devoted to an overview of important cases of the German Federal Administrative Court (Bundesverwaltungsgericht) in 2015. The subjects of this work are based on the Annual Press of the Federal Administrative Court 2015. The cases analysed in this article are: BVerwG 1 C 22. 14 - Urteil vom 16. Juli 2015(Vorsorgemaßnahme gegen Bioaerosol Belastung) BVerwG 2 C 13.14, 15.14, 18.14, 27.14, 28.14, 5.15-7.15, 12.15 – Urteile vom 17.
