현 생명보험계약의 자살 면부책조항은 자살과 관련하여 면책기간 이후 보험사건발생의 우연성을 심각하게 훼손시킴으로 생명보험계약이 피보험자들의 보험금 수령을 목적으로 하는 자살과 일반자살을 촉진시키는 기능을 수행할 우려가 다분하다. 따라서 본 논문은 기존의 소수설이 제기한 문제점에 더하여 현 자살 면부책조항과 관련된 문제점들을 새로운 각도에서 추가적으로 조명하고, 현재의 자살 면부책조항 아래에서 생명보험계약이 실제로 자살의 촉진제로 작용하는지의 여부를 검증하기 위한 실증분석을 시도하였다. 분석결과 현 조항 하에서 생명보험계약이 면책기간 이후 피보험자의 특히 여성의 자살을 촉진시키는 것으로 나타났다.
Abstract
The current suicide clause in the life insurance policy seriously spoils the contingency requirement of life insurance and thus, it has high possibility to cultivate the suicide of the insured, particularly after exclusion period. We reconfirmed the fact along with the prior studies and tried to suggest some additional issues related to the current suicide clause. And we also performed empirical analysis to prove whether the life insurance policy works as a suicide cultivator under the current suicide clause. We found statistically the current clause tends to motivate the suicide of insured, particularly in case of women.
