미국의 학생장기결석 관련 법제 및 시사점

연구결과에 따르면, 학생의 장기결석(무단결석)은 낮은 성취도, 낮은 자존감, 낮은 진급율과 졸업율, 낮은 취업률로 이어져 종국에는 학교중도탈락으로 이어질 가능성이 높은 것으로 나타났다. 실제 고등학교 중도탈락생 중 52%가 구직에 성공했지만, 고등학교졸업자와 대학졸업자는 각각 71%와 83%가 취업한 것으로 나타나면서 무단결석이 개인의 삶의 질을 떨어뜨리는 것은 물론 사회경제적으로 부정적인 영향을 주는 악순환으로이어지는 것으로 밝혀졌다. 이처럼 학생의 장기결석에 대한 교육적, 사회적, 생애사적인영향을 고려했을 때, 미국에서 시행하는 관련 법제와 사례에 대한 연구는 우리나라 교육에 의미 있는 시사점을 제공한다. 이제 무단결석을 학생 개인의 문제로 국한하지 않고 사법부가 사안에 따라서는 부모 또는 보호자에게 벌금 또는 징역형까지 엄격한 기준을 적용하여 자녀 보호와 교육을 위해 그들의 능동적인 역할을 강제할 필요성도 있다고본다.
Abstract
The definition of truancy in the United States of America is usually established by school district policy and many vary across districts. Any unexcused absence from school is considered a truancy, but states enact their own school attendance laws. According to a research result, high school dropouts had a 52% employment rate, compared to 71% for high school graduates and 83% for college graduates. Excessive absences and truancies usually equate to poorer achievement, mediocre self-esteem, lower promotion and graduation rates and lesser employment potential, all of which frequently lead to a student dropping out of school. In the United States of America many programs work with law enforcement and the judicial system(especially including Juvenile Court) to enforce attendance and truancy policies. These programs often hold parents accountable for their child attendance. Sanctions are often in terms of fines levied against the parents. Students are often given community service to serve on their own time as a consequence of poor attendance.
