Abstract

Recently, some serious problems about school teachers are caused by parents organization. It is 'teacher evaluation' that they want to distinguish "incompetent teachers" from the competents. Nevertheless, no criteria or standards to evaluate teachers does exist. This study tries to make clear the notion of "incompetent teacher", and then to find out the range of possible application with disciplinary system. In every activities occur in school have to orient one objection, the education, so the criteria of distinguising teachers is, also, whether the activity is valuable to education. If teacher's activity or personnel behaviour is harmful to student(s) and have serious trouble at the instruction, then the teacher must got some official reprimand. In this premise, analyse the cases of Court and Decision Anthology of Appeal Commission for Teachers 1999-2004. Instruction, classroom guidance, personnel characteristics and traits for teacher are the main dimensions of classification. When a teacher have to get some judgment for his/her incompetent behaviour or activity, there have to consider the criteria, whether he or she did it by accident or on purpose. If it was by accident, the hard punishment is too severe. In conclusion, there must be some improvement in perception about teacher evaluation and reprimand system, and legal, institutional supports. Most of all, the members of school have to realize that the teacher evaluation or classifying incompetent teacher is one way to improve our public education and teacher's right on education.
