미국 교육법의 최근 연구 동향 및 시사점

미국 교육법의 최근 연구동향과 이슈를 파악하기 위해 교육법연구의 대표적 학회인Education Law Association(ELA)의 2016년도 학술대회 주제발표문, 그리고 대표적교육법 관련 논문집 Journal of Law & Education(JLE)에 게재된 논문 주제들과 대학교재에서 다루는 주제와 내용을 종합, 분석하였다. 분석 결과, 미국의 교육법학에서가장 많은 관심을 가지고 있는 연구주제는 차별(성별, 연령별, 인종별)의 문제, 장애아관련 문제, 학생과 교사의 권리, 종교 관련 법률, 학생기록부 등 학생의 프라이버시관련 법률로 나타났다. 최근 공립학교에서 흑백통합, 트렌스젠더의 권리, 국가 및 학교의 안전 등에 대한 이슈가 부상하고 있었지만, 상대적으로 노조, 학교재정 등 경영적인 측면에 대한 관심은 적었다. 또한 연방교육법과 관련한 쟁점의 경우, 오바마 행정부에서 조지 W. 부시 행정부의 NCLB(낙오학생방지법)을 재인가한 ESSA(모든 학생의 성공을 위한 법)과 연방정부 교육 관여의 대표적 사례로 꼽히는 공통중핵 성취기준(Common Core Standards)에 대한 동향 파악에 따르면, 연방차원의 큰 틀에서 교육의 권한을 각 주에 되돌려 주는 변화를 확인할 수 있다. 한편 미국의 연방교육법의시행 방향은 공화당 소속 도날드 트럼프의 대통령 당선으로 연방정부의 주 교육에 대한 관여가 더 줄어들고 관련 법률의 변화도 예상된다.
Abstract
According to the analysis of Journal of Law & Education and Education Law Association in the United States, lawyers, law professors, school teachers, and law researchers have strong interest about the issues concerning discrimination(age, sex, and race, etc.), religion, disabled, the rights of students and teachers, and student’s record. Although much is unknown about how the incoming administration will proceed on the public education, there is prospect that the incoming Donald Trump administration could scale back the federal role in the education of State and drastically reduce the role of U.S. Department of Education. Also Trump does not support the Common Core Standards to standardize educational requirements across the nation. There are prospects that Trump administration is likely to oppose positions taken by Obama administration.
