Abstract

The purpose of this study is to analyze the the results of the direct election system for superintendents(hereinafter referred to as DES) and to explore alternatives. This thesis consists of five chapters from the problem situation to the evaluation and tasks. The framework of the discussion is diagnosed in terms of Norm validity, Institutional validity, and Actual effectiveness. The norm validity was analyzed through the cases of the Constitutional Court. The institutional validity was analyzed by applying the principle of independence, resident control, professional management, decentralization, and efficiency. The actual effectiveness was discussed through the results of election, the superintendent's authority, the voter's perception and public opinion survey on the DES. As a result, the DES is the most democratic election that conforms to the the Constitution, and it is a system that ensures the independence of education. The qualification requirements for candidates aim to harmonize between the principles of professional management and resident control. The DES means decentralization in education equal to that of the provincial governor. However, the DES has the limitation of being a "high-cost, low-efficiency" election method. However, the DES is still the most popular among residents. On the other hand, the alternative to the running mate system for provincial governors has a high risk of political dependence on education and is unconstitutional. Therefore, it is a reasonable direction to revise the DES rather than abolish it. The legislative tasks are as follows; The election system by complete public management, revitalization of manifesto, step-down of the election age, review of the superintendent's autonomous legislative power and 17 powers, and the revival of the education members of local council for professional checks.
