스포츠 페어플레이의 규범적 정당화 문제 -재정적 페어플레이를 중심으로-

전통적으로 페어플레이는 스포츠 현장에서 공정성을 수호하고, 참가자들로 하여금 정의로운 판단에 근거한 행동으로 이끄는 하나의 도덕적 관념으로써 그 가치를 인정받아 왔다. 그러나 최근 프로스포츠의 급속한 발달은 스포츠 자체의 가치관 변동을 초래하여 페어플레이에 대한 새로운 이해를 필요로 하고 있다. 따라서 본 연구에서는 최근 스포츠 세계의 바람직한 경쟁과 공정성을 제고하기 위한 한 방편으로써 대두되고 있는 UEFA의 재정적 페어플레이를 중심으로 이를 하나의 도덕규범으로써 정당화하려 할 때 불거지는 문제들을 검토하였다. 그 결과 전통적인 시각에서 행위자의 미덕으로 간주되던 페어플레이는 승리나 금전적 이익 등과 같이 새로운 스포츠의 목표와 관련하여 전통적인 공정성과 평등의 문제를 통해서는 도덕규범으로 정식화하기에는 한계가 있으므로 현대의 페어플레이라는 관점에서 적절한 표준화 절차를 통해서 규범적 정당화 가능성을 발견할 수 있다고 밝혔다. 이런 맥락에서 재정적 페어플레이 또한 행위자로 하여금 공유된 가치관 아래로 유도하는 기능을 발휘하기 위해서는 적절한 표준화 절차를 통해서만이 가능하며, 이는 재정적 페어플레이가 비록 전통적인 도덕적 규범들에 의해 설명될 수 있는 개념이 아니라 하더라도 스포츠윤리의 특수성에 의해 일련의 도덕적 규범으로 옹호될 수 있는 가능성이 있음을 주장하였다.
Abstract
Fair play has traditionally been considered to be of great value as a moral ideology to advocate the impartiality of sport and urge athletes to compete in a righteous way. In recent days, however, the rapid development of pro sports has brought a change to sport values, and it's now consequently required to see fair play in a new light. The purpose of this study was to examine the justification of the UEFA's financial fair play as a sort of moral norm. The UEFA's financial fair play has lately been highlighted as a means to further an ideal competition and fairness in the sport world. As a result of looking into how that could be justified as a moral norm, it's found that the traditional concept of fair play regarded as a virtue of a performer couldn't officially be viewed as a moral norm when new goals of sport such as victory or financial profit are taken into account. It seems that in modern times, the normative justification of fair play is impossible without the standardization of it. And financial fair play is expected to stimulate performers to share the same values. Although financial fair play isn't what can be explained by conventional moral norms, it's possible for that to be advocated as a sort of moral norms due to the specificity of sport ethics and thereby to give a clue about how to keep ensuring fair play in rapid-changing sport environments.
