도심 주택 공급 확대를 위한 주요 정비사업의 이주대책 제도 특성과 정책적 시사점

Abstract

This study analyzed the characteristics of relocation measures(RM) in the Land Compenstion Act(LCA) and individual project laws as a cornerstone for the smooth implementation of major urban improvement projects and drew policy implications. Based on the characteristics of RM for Redevelopment Projects(RP), Urban Public Housing Complex Projects(UPHCP), and Urban Housing Complex Projects(UHCP), the policy implications include the followings. First, the RM for RP and UPHCP are largely the same as those under the LCA and are designed to compensate the homeowners and tenants who lose their homes. On the other hand, UHCP extend the scope of compensation for ‘Residential Relocation Expenses(RRE)’ as RM to the owners and tenants who engage in business activities. It is significantly different from the other projects. It is meaningful as an opportunity to partially supplement the limited meaning of the RM as a residential measure by legislation the need for relocation support in addition to business compensation for immigrants who lose their business base. Second, in the case of publicly-led UPHCP, it is necessary to consider the so-called ‘Business Relocation Expenses(BRE)’ compensation to support the relocation of shop owners and tenants who lose their business base. Third, in order to reduce confusion and conflicts caused by differences in RM for similar projects, it is necessary to consider introducing a tentative BRE compensation in the LCA. Fourth, as one of the common and most practical measures for RM, the provision of relocation financing support is necessary to be extended in addition to the housing loan support.
