1920~1930년대 초 소작쟁의가 확대되던 상황에서 일본정부는 지주적 토지소유를 일정하게 제한하여 소작권을 보호할 목적으로 소작입법을 추진했다. 소작법안은 관민 합동의 조사기관을 지향하는 소작제도조사위원회, 소작조사회, 사회정책심의회 등 정부 내 위원회의 심의를 거쳐 입안되었으며, 이를 주도한 세력은 개혁 성향의 농림관료들이었다. 소작법안은 농림성에서 작성되어 사법성의 심의 후 1930년 12월 법제국에서 심사되고, 1931년 1월 각의에서 결정된 후이해 2월 제국의회에 상정되었다. 일본의 소작법안은 영소작에까지 적용되었고 소작기간(최단기간 5년) 보장을 비롯하여 소작권 해제 제한, 소작계약의 제3자에 대한 효력 보장, 소작료 감면 등에 대한 규정들이 담겨, 민법상 지주의 권익을 제한하고 소작농의 안정을돕는 내용으로 되어 있었다. 이로써 농업생산력을 실질적으로 담당하고 있는자·소작 중농층을 사회적 지주(支柱)로 만들어 농촌 지배 체제의 근대화를 달성하려고 했다. 일본에서 소작입법은 지주제를 위로부터 부르주아적으로 개혁하고자 기획된 것이었다. 소작법안은 1931년 3월 중의원을 통과했으나, 보수적인 귀족원의 심의 중단으로 입법이 무산되고 말았다. 비록 일본정부의 소작법 제정을 위한 움직임은 중단되었으나, 소작법안의 ‘경작권 강화’ 방침은 1930년대 초중반 소작쟁의 조정에서 어느 정도 실현되었다.
Abstract
Under the situation when the tenant disputes were expanding in the 1920s~early 1930s, the Japanese government pushed the tenant farming legislation with the purpose of protecting the tenant right by applying certain restrictions to the land ownership. The bill for tenant law was drafted through the deliberations of committees within the government that strived for a joint government–civil investigative agency, and the forces initiated such movement were reform-minded government officers in agriculture and forestry. The bill for tenant law was drafted by the Ministry of Agriculture and Forestry to have the deliberation of the Ministry of Justice, followed by a review by the Cabinet Legislation Bureau in December 1930, and determined by the cabinet in January 1931 to eventually presented to the Imperial Diet of Japan in February of this year. The bill for the Tenant Law in Japan was consisted with the contents to restrict the rights and interests of landlords that was guaranteed by the civil law as well as contents to help stabilizing tenant farms. Therefore, by making the independent farmer and farm tenant that practically undertook the agriculture production to the social pillar in a way of accomplishing the modernization of the farm village control system. This bill for tenant law passed the House of Representatives in March 1931, but with the suspension of deliberation by the conservative of the House of Peers, it was failed for legislation. Although the movement of the Japanese government for legislating the tenant law was suspended, the policy to strengthen the right of cultivation of the bill for tenant law was materialized to a certain degree in the tenant dispute reconciliation in early and mid–1930s.
