다문화가족 관련 법제에 관한 소고

현재 우리나라는 거주외국인의 수는 115만명으로 다문화다인종사회로 급격하게 변모하고 있다. 특히 한국인 남성과 외국인 여성간의 국제결혼의 증가는 2000년 이후부터 두드러진 현상으로 나타나 현재는 일반적인 결혼의 형태가 되었다. 2009년 현재결혼이민자의 수는 167,090명이며 이중 결혼이민여성의 수는 149,853명을 이주여성화를 나타내고 있다. 이중 서울시에 거주하는 결혼이민여성은 32,558명으로 21.7%가거주하고 있다. 그러나 이들은 언어적 문제, 경제적 곤란, 자녀양육, 문화적 차이 등으로 인해 애로를 겪고 있는 실정이다. 이들의 우리 사회의 주체로서 안정적인 사회정착을 위해서는 관련법체계가 정비되어야 하며 제도적으로 종합적인 다문화가족정책이 추진되어야 한다. 이를 위해 제2장에서는 현재 결혼이민자들의 지역적 거주분포현황과 다문화가족정책과 추진체계에 대해 살펴보고 제3장에서는 외국의 다문화가족에관한 입법례를 검토하며 제4장에서는 다문화가족 관련법제인 재한외국인처우기본법,다문화가족지원법 및 지원조례 등을 중심으로 주요 내용 및 문제점을 검토하여 개선방안을 제시한다.
Abstract
As a result of globalization, Korea is experiencing a dramatic change to a multi-cultural society with 1.15 million foreign residents. The international marriage between Korean men and foreign women has increased substantially since 2000,and it now became one of the common types of marriage. The number of marriage immigrants is 167,090 in 2009 and the number of women is 149,853, which clearly depicts feminization of migration. Over 32,558 marriage women immigrants, which is 21.7%, are living in Seoul. They are suffering from language problems, economic difficulties, child-rearing burden, and cultural differences. Therefore, we have to make an effort to exclude discrimination and prejudice which these immigrants are facing by acknowledging them as components of our society. And laws and policies which are suitable in the stable social infrastructure for multi-cultural society have to be established. Consideration and systemic have to support for the multi-cultural family in terms of legal policy are in demand. Chapter 2 will show the population distribution of marriage immigrants,policies of multi-cultural families in Korea. Chapter 3 will examine change of the law of Immigrants Law in Sweden and France. Through analysis of The Fundamental Act on Foreign Residents and The Supporting Act for Multi-cultural Familie in Chapter 4 I will seek possible legal solutions to this social issues.
