해양지적 도입을 위한 중국 해양공간관리제도에 관한 연구

새천년을 맞아 선포된 ‘해양한국21’과 국토해양부의 출범으로 한국은 해양과 해양자원의 지속 가능한 개발에 한 걸음 더 다가서게 되었다. 그러나 해양공간관리의 복잡성에 더해진 한국의 정립되지 않은 법·제도적 해양관리 기반은 경제의 우선순위 변화에 따라 늘어나는 해양생태계 문제들과 함께 해양경계와 관련한 분쟁을 양산하고 있다. 반면, 중국은 2002년 『해역사용관리법』을 통해 해상경계와 관련된 개인적 사용권의 보호와 관리를 실시하고 있다. 본 연구에서는 해역사용관리제도를 위주로 중국의 해양공간관리 현황을 고찰함으로써 향후 한국이 해양지적제도를 도입함에 있어 시행착오를 줄이고 효율적인 제도로 만드는 데 도움이 되고자 한다.
Abstract
With the enactment of Ocean Korea 21(2000) and launch of the 'Ministry of Land Transport and Maritime Affairs', South Korea has made a commitment towards the sustainable development of its ocean and coastal resource. The complexities of marine area management with a complex legal and institutional framework have been escalating conflicts related to marine boundary, and increasing pressure to address ecosystem problems. In contrast, China associated with the maritime boundary right protection and management has been carried out with appropriate law successfully. Therefore, this study performed benchmarking through the chinese marine cadastral system and proposed methodologies would help to establish an effective marine cadastral system in South Korea.
