Abstract
【Abstract】 Study on CISG Article 46 Jung, Hyung-Jin Article 46 grants the buyer the remedy of requiring the seller to perform his obligations under the contract(Article 46(1)), to deliver substitute goods(para.2), and to effect repair(para.3), if the seller does not perform one of his obligations. In interaction with Article 48 and 49, this rule expresses the principle of priority of the right to require performance. Paragraphs 2 and 3 contain clarifications of content and constrains on the claim for performance in case of delivery of non-conforming goods. The buyer's right to return non-conforming goods should be restricted to serious cases that represent a fundamental breach of contract. In contrast to delivery of substitute goods, the right to claim repair presupposes not that the lack of conformity constitutes a fundamental breach of contract, but only that it is reasonable to require repair by the seller.
