친일반민족행위에 대한 청산과제는 신생 국가 대한민국의 가장 중요한 국가적 과업이었다. 그러나 해방 직후 친일반민족행위에 대한 청산은 이루어지지 못했다. 그 결과 한국현대사 최대의 비틀림이 노정되었다. 1946년 1월 28일 민주주의민족전선은 친일파와 민족반역자에 대한 규정을 발표하였다. 1946년 12월 12일에 개원한 과도입법의원은 ‘부일협력자 민족반역자 전범 간상배에 대한 특별법률 조례’ 초안을 제출하였다. 1948년 5월 10일 선거를 통해 성립한 제헌의회는 ‘반민족행위처벌법’을 제정하였으나 한국전쟁이 진행 중이던 1951년 2월에 이 법은 폐지되었다. 2004년 3월 ‘친일반민족행위진상규명특별법’이 제정되었다. 이 법률은 기본적으로 개인의 행위를 대상으로 하고 있다. 그 결과 기관이나 단체가 중심이 되어 행한 친일반민족행위를 청산할 수 없는 문제가 발생하였다.
Abstract
The task of liquidation for pro-Japanese and anti-national acts was the most important national task of the newly born nation of Korea. Immediately after Korea's liberation, however, there was no settlement of pro-Japanese and anti-national acts. As a result, the biggest twist in modern Korean history was exposed: On January 28, 1946, the Democratic National Front announced regulations against pro-Japanese and national traitors, and the Transitional Legislative Committee, which opened on December 12, 1946, submitted a draft of the "Special Law Ordinance on Supplementary Japanese Collaborators, National Traitors, and War Criminal Kankaku Shojae". 1948. In March 2004, the "Special Law on the Inquiry into the Truth of Pro- Japanese Anti-National Acts" was enacted. This law basically targets individual acts. As a result, the problem arose that pro-Japan anti-national acts committed mainly by institutions and groups could not be liquidated.
