Abstract
As we have seen, in England and Wales, youths are identified as the subject of rights and they are protected and supported through various means of intervention to ensure their right to development. Out-of-home youths are a representative type of subject that requires welfare intervention. In England and Wales, related laws and guidelines have been enacted to stipulate that multi-authorities such as local governments and police should cooperate and provide necessary protection and support. In particular, the police are the first to find out-of-home youths and have the authority to take necessary measures for foster care, emergency protection orders, etc. This process issecured by the establishment of a systematic cooperation including information sharing among related organisations. When out-of-home youths commit anti-social behaviour, the police have the authority to take measures to regulate their behaviour and to protect them. There are several criticisms relating to these measures such as the introduction of an ambiguous concept of anti-social behaviour and excessive control over the behaviour of youths. However, the police in England and Wales do not operate the system on aregulation-by-regulation basis, but they provide various support to them along with the related organisations in connection with the diversion. On the other hand, in Korea, the information sharing and cooperation system among the related agencies is not properly equipped, and it is difficult to protect youths outside the home at the police level due to limitations of laws. In this respect, the case of England and Wales police is helpful in improving our protection system.
