수출기업의 효율적인 비확산 수출관리를 위한 내부관리시스템 구축방안 연구

초록

본 논문의 목적은 수출기업의 비확산 수출관리를 위한 내부관리프로그램 구축에 도움이 되는 유의사항 및 효율화전략을 수립하고, 그에 따른 시사점을 제공하는 것이다. 이를 위해 수출관리의 근거체계, 통제수단의 내용 및 방향, 한계점, 효율화방안 등을 분석하였다. 수출기업은 리스트통제와 광범위통제수단을 고려하여 내부관리프로그램을 구축할 필요가 있다. 구축과정에서는 수출관리조직, 출하관리, 감사, 교육, 문서관리, 자회사 지도, 행정제재 등의 행정관리 차원과 거래부적격자 심사, 최종용도 및 최종사용자의 심사, 통제리스트 해당여부 심사, 전용위험 심사 등의 심사차원으로 구분하여 추진할 필요가 있다. 이러한 요소들은 분산관리방식이나 집중관리방식, 또는 직접관리방식이나 간접관리방식을 비교해서 기업의 규모와 영업방침, 전문인력 구조 등을 참고해서 운영할 필요가 있다. 시행세부전략과 관련해서는 계약과정, 시장조사 및 거래선 조사과정, 수송과정별로 효율화전략을 마련해야 한다. 특히 계약과정에서는 거래 부적격자리스트 포함여부, 최종목적지, 최종설치 및 사용장소, 수송방법이나 수송표시, 포장 및 포장표시, 지불가격 및 지불조건, 지불방법, 비밀보장 요구 등의 확인을 철저히 해야 한다. 이러한 과정에서 자체판단이 어려운 경우는 외부공식기관에 의뢰해서 상담을 받아야 한다. 정부는 비확산 수출관리를 위한 기업의 내부관리프로그램 구축을 지원하기 위해 허가과정의 온라인화 및 실시간 제공, 정보수집능력의 향상과 기술심사체제의 구축, 정보교환네트워크의 강화, 상담 전문인력의 양성, 연수회 및 설명회의 확대 등에 주력해야 한다.

Abstract

Objection of this thesis is to analysis about efficient strategies which will help firms carry out efficient, voluntary for export controls. In order to have effective export controls, it is not sufficient to have an export control system at the government level, it is also necessary to have effective internal compliance program within firms. Internal compliance program can be a useful tool to help firms comply with export control requirements with the Guideline(Catch All and List Control). If the exporter is aware that items in question are intended, entirely or in part, for a military end-use, the exporter must notify the authorities, which will decide whether or not it is expedient to make the export concerned subject to authorization. The establishment of a ICP, in and of itself, will not relieve an exporter of criminal and administrative liability under the law if a violation occurs. However, the implementation of an ICP, coupled with good and sound judgement, can greatly reduce the risk of inadvertently exporting to an unauthorized party or for an unauthorized end-use.
