Abstract

In many countries' Patent Acts including our country provide an exemption from patent infringement liability for experimental use. Thus, it is not an infringement of patent to make, use, assign the patent for the purpose of research and study when the patent is alive. However, the scope of the limit is different. United States provides a very narrow exemption but our country does not. In general, those who assert the limited application of experimental use focus on the protection of patent right holders. However, those who claim the broad application of experimental use put weight on the development of technology through improving the technology. This paper examined which one is reasonable and then what is the direction for our patent law. Therefore, it reached a conclusion to interpret the experimental use exemption more broadly. One of the reasons is that since the purpose of the patent law is the balance of interests between patent holders and the public, the scope of the limit should not narrow. Also, when considering that the experimental use exemption is the effect of disclosure of a patent under the patent system, and that the broad interpretation of the experimental use exemption does not make the patent weak, experimental use exemption should be interpreted more broadly. Moreover, the US law interprets the experimental use exemption for the pharmaceutical patents broadly, but it is not proper to discriminate them with other patents.
