중국의 중재제도에 대한 연구: 의료분쟁을 중심으로

중국은 중재법을 통하여 중재의 절차, 내용, 효력에 대하여 규정하고 있으며, 우리나라와 같이 중재판정부의 판정은 판결과 동일한 법적 효과를 가지도록 규정하고 있다. 중국은 중재법과 인민조정법을 통하여 대체적 분쟁해결방식에 대하여 규정하고 있으며, 의료사고 조례, 의료분쟁 조례를 통하여의료분쟁의 당사자가 소송 외의 방법으로 분쟁을 해결할 수 있는 방법들을 제시하고 있다. 이 중 협의나 조정으로 분쟁을 해결하였다고 하더라도 그 이행의 확실성을 담보하기 위해서는 법원에 합의에대한 유효성을 확인하여야 한다. 본 연구에서는 중국의 의료분쟁에 대한 대체적 분쟁해결방식에 대하여 연구를 진행하고, 특히 중재법에 근거한 의료분쟁 해결에 대하여 심도 깊게 연구하여 그 시사점을제공하고자 한다.
Abstract
China regulates the procedures, content, and effectiveness of arbitration through its Arbitration Law, and similar to our country, it stipulates that the decisions of the arbitration tribunal have the same legal effect as court judgments. Through the Arbitration Law and the People’s Mediation Law, China regulates alternative dispute resolution methods. Through the Medical Accident Regulations and Medical Dispute Regulations, China presents ways for parties involved in medical disputes to resolve their conflicts without law suit. Even if disputes are resolved through negotiation or mediation, the validity of the agreement must be confirmed by the court to ensure the certainty of its implementation. This study aims to explore alternative dispute resolution methods for medical disputes in China, focusing in-depth on the resolution of medical disputes based on the Arbitration Law, and to provide insights from this research.
