최근 4차 산업혁명에 따른 사회적 영향과 대책 논의가 활발하다. 개별 전문분야마다 4차 산업혁명 현상의 사회적 의미를 살피고 현안을 선별하는 구체적 작업을 신중하게 진행해야 한다. 그런 점에서 본 논문은 ‘4차 산업혁명 형사정책(Criminology of the Fourth Industrial Revolution)’을 모색하는 데 목표가 있다. 4차 산업혁명의 긍정적 효과에 대한 형사정책적 수용방안으로서는 인공지능기반 사법시스템 효율화, 인공지능기반 치안서비스 강화, 빅데이터기반 예방적 경찰활동 확대, 가상･증강현실기반 교정치료프로그램 개발 등이 검토대상이 될 것이다. 또한 4차 산업혁명의 부정적 영향에 대한 형사정책적 대응방안으로서는 정부와 기업의 시민 사생활 감시, 디지털 정체성의 침해, 인공지능 로봇기술의 범죄적 악용, 자율운송수단의 범죄적 악용, 사물인터넷의 범죄적 악용, 3D 프린팅의 범죄적 악용, 인공지능･빅데이터 의사결정의 범죄적 악용, 가상･증강현실기술의 범죄적 악용, 그리고 사이버범죄와 사이버테러가 검토대상이 될 것이다. ‘4차산업혁명 형사정책’의 과제는 사이버보안체계의 민･관협업, 사이버보안 강화를 위한 형사법제정비, 인공지능기반 자율기계의 침해결과에 대한 형사책임 규명, 개인정보와 사생활 보호를 위한 형사법제의 정비, 첨단기술산업 발전을 위한 형사법적 규제의 정비라 할 수 있다. 특히 첨단 지능정보기술의 혜택을 사회적 약자와 위험결손 지점에 우선적으로 투입하는 선용의 원칙과 그러한 원칙에 합의하고 실천하는 사회적 경험이 축적되어서 궁극적으로 기술 오용과 악용으로 인한 위험과 범죄적 사태에 대처하는 기법과 법제가 구현되어야 할 것이다.
Abstract
This essay aims to propose a model of ‘Criminology of the Fourth Industrial Revolution’. The Fourth Industrial Revolution is characterized by new technologies that are fusing the physical, digital and biological worlds, and impacting all disciplines, economies and industries, as Klaus Schwab of the World Economic Forum suggests. Central to the Revolution are emerging technology breakthroughs in fields such as artificial intelligence, robotics, the Internet of Things, autonomous vehicles, 3D printing and bio technology. From the perspective of criminal laws and criminal justice policy, policy-makers and researchers face both challenges on how to utilize the benefits of the technology and how to control the threats from the technology. Criminological research and debates are demanded on the issues of AI-based criminal procedures, AI-based policing and investigation, predictive policing based on big-data analysis, and correctional and treatment programs based on virtual/augmented reality technologies. On the other hand, legal and political measures against criminal threats and violations of privacy by technologies, such as surveillance by government or big companies, violations of digital identity, criminal events of intelligent robot, autonomous cars and drones, 3D printing, bio-printing, virtual reality, security breach of Internet of Things, and cyber-terrorism. Thus the main tasks of the ‘Criminology of the Fourth Industrial Revolution’ should be the building of cyber-security system based on public-private partnership and international cooperation. And legal reforms of cyber-security and privacy protection in the age of intelligent-date society will be the key to the future of the Fourth Industrial Revolution.
