전자거래 기반으로서 전자신원관리 및 신뢰서비스 법제에 관한 小考

Abstract

Recently, various policies and additions to legislation have been made in the United States, Japan, and other countries for electronic identification and trust services, as well as at the international level, such as in the EU and the UN. However, in Korea, the legal system is limited to identity management and trust services based on the Electronic Signature Act. It is suggested that, with the development of various authentication-related technologies such as biometric information, national policies to develop related industries and revitalize electronic transactions need to be promoted. In addition, in the use of means for online identification, the law needs to secure an appropriate level of guarantee based on the risk assessment of transactions. In order to establish and support an efficient electronic identification system, it will be necessary to review related laws such as those regulating the accuracy, privacy, and security of identity information and identity management procedures. In the case of trust services, the Electronic Signature Act should be fully implemented, allowing electronic signatures to be used in transactions requiring conventional signatures. Moreover, the legal system should be overhauled to include various trust services that reflect new technologies such as blockchain. Non-face-to-face is expected to intensify in the future. Detailed review and analysis of foreign policies with regard to electronic identification and trust services should inform the enactment or revision of laws and regulations in Korea.
