Abstract

Current government has suggested self-regulation, a new regulation model. Currently, there is controversies over the concept, operation, and scope of application of self-regulation. Self-regulation can be both effective and problematic. This research would review precedents of self-regulation in US and find out the implication. Federal Communications Commission is representative agency which has control on some of self-regulation issues. It operates self-regulation through indemnification and cooperation with private organizations. Parents Television Council is representative private organization and section 230 of the Communications Decency Act is an example of indemnification. Currently, Federal Trade Commission leads US self-regulation. It also cooperates with private organization and uses indemnification system named ‘Safe Harbor’. Safe Harbor suggests that FTC evaluate guidelines made by self-regulation organizations and approve it. If it is proved that the company has complied with the approved guidelines, it will be exempted from responsibility for unexpected violations. US is currently responding to the issue of personal data violations by producing various laws and guidelines. FTC and state government take part in it. The current U.S. self-regulation is driven by the private sector. The private sector has developed programs to comply with guidelines. These programs are called ‘Reg-Tech’. YouTube is even distributing them to other companies. Currently, Korean companies are planning to expand the ‘communication service’ to enhance the competitiveness. Considering this and domestic companies’ overseas expansion, it can be expected that Reg-Tech might be an important factor of a company. Currently, in Korea, both government and private companies are investing to technologies that can be used for regulation. If an institutional basis is established to encourage public-private cooperation, Korea will be able to occupy an advantageous position in the “regulatory market”.
