Abstract

Island regions have characteristics that differ from those of inland areas such as rural or urban regions. Surrounded by the sea on all sides, islands are marked by both openness and isolation. Because of their distance from the mainland, these regions are often marginalized politically, economically, socially, and culturally. In addition, the limited space available for land use imposes many restrictions on productive activities. As a result, compared to mainland areas, island regions face various constraints in political, economic, social, and cultural aspects, and remain underdeveloped and marginalized in nearly all sectors, including policy, administration, consumption, education, and culture. In particular, the healthcare sector is a representative example that clearly reveals the vulnerability of island regions. To overcome these limitations, South Korea sought to establish an efficient healthcare system for island regions and to enact a support law that comprehensively includes institutional systems for healthcare services. As part of this effort, the Medical Service Act was amended in 2002, leading to the introduction of the telemedicine system for the first time. In March 2002, the government officially recognized telemedicine through the amendment of the Medical Service Act (Article 30-2 on Telemedicine, currently Article 34), and in 2003, the government sought to promote the use of telemedicine by establishing the enforcement regulations of the Medical Service Act. However, there are still various differing opinions on telemedicine, and efforts such as amending the Medical Service Act and implementing related policies and systems remain insufficient. While the government and the industrial sector advocate for the expansion of telemedicine, many in the medical community oppose it due to concerns about medical accidents and the commercialization of healthcare. Accordingly, this paper examines the scope and limitations of telemedicine under the current Medical Service Act. It then explores the issues present in the current legal provisions related to telemedicine and proposes possible solutions, with the aim of expanding telemedicine as a means to improve healthcare services for residents of island regions.
