대한제국의 역사적 종점에 관한 재고찰

대한제국의 역사적 종점은 언제였을까? 1910년 병합조약이 성립되지 않았다는 주장과 1910년을 대한제국의 소멸시점으로 보는 역사적 서술은 논리적으로 상충한다. 아울러 1904년 대한제국의 황성을 점령한 이후 1910년까지 일제가 강박했던 일련의 조약들을 원천무효였다고 보면서, 역시 일제에 의해 강박된 1907년 광무황제의 정헌황태자(순종)로의 황위이양은 유효했던 것으로 보는 것은 논리적 모순이다. 강박무효설에 따라서 1907년의 황위이양 또한 무효였다고 본다면, 1910년 이후 일제의 조선총독부가 실질적 행정부로서 한반도에 대한 통치권을 행사했다는 사실과는 별개로 한국사에 있어서 대한제국의 역사적 종점은 광무황제가 훙거하고, 대한민국 임시정부가 수립된 1919년으로 보아야 할 것이다.
Abstract
When did the Daehan(Great Korea) Empire cease to exist? Established in 1897, the Daehan Empire with a territorial jurisdiction over a part of Manchuria (Gando) as well as the Korean peninsula proper, was the first modern sovereign state based on the Westphalian nomos. This paper addresses the question of the endpoint of the Daehan Empire. Especially, it deals with a contradiction between the legitimacy of Emperor Gwangmu (also known as Gojong)'s abdication, Prince Jeongheon (also known as Soonjong)'s imperial succession in 1907, which was coerced by Japanese military authorities in Korea, and validity of a series of treaties struck between the Daehan Empire and Japanese Empire from 1904 to 1910 which many regard as null and void as initio because they were made as a result of Japanese coercion. If this latter interpretation is correct, and the former is to be rejected, then the endpoint of the Daehan Empire should be the death of (retired) Emperor Gwangmu, which was immediately followed by the establishment of the Provisional Government of the Republic of Korea (Daehan Minguk Imsi Jeongbu) in 1919.
