Abstract
This study aims to analyze the contested issues surrounding the concept of educational autonomy, which serves as both the constitutional foundation and core principle of local educational governance systems, and to develop discussions on these issues. Emerging from the post-liberation context of eliminating Japanese colonial legacies and recovering national sovereignty, the concept of educational autonomy was incorporated into the 1949 Education Act to provide legal grounds for the local educational governance system transplanted from U. S. military administration. Subsequently, it was elevated to constitutional status alongside political neutrality in education during the Fifth Constitutional Amendment in 1963, and educational expertise was added during the Eighth Constitutional Amendment in 1980. Notably, all three principles of education were incorporated into constitutional amendments immediately following military coups, reflecting the authoritarian regimes' accommodation of educational stakeholders' demands to secure political legitimacy. Despite its significance, educational autonomy lacks a clear conceptual definition and established scope. Through analysis of the legislative incorporation process of educational autonomy, legal principles evident in Constitutional Court rulings, and contested issues surrounding local educational governance systems, this study confirms that the concept of educational autonomy possesses multilayered and ambivalent characteristics. Paradoxically, educational autonomy has reinforced centralized educational administration. Based on discussions of these issues, this study proposes that the concept of educational autonomy needs to be complemented with the perspective of "prohibition of improper control" as presented in Japan's Fundamental Law of Education. Furthermore, it suggests the necessity of strengthening decentralized autonomy through devolution of educational authority to schools, establishing cooperative governance between general and educational administration, and developing democratic educational governance models that ensure diverse civic participation.
