Abstract
The emergence of the platform economy has led to a rapid development of sharing economy and collaborative consumption. Despite many advantages of the sharing economy model, there has been controversy over the illegal nature of the participants in the sharing economy market due to the lack of proper legislation reflecting the economic phenomenon. In this paper, the Sharing Economy Basic Law Bill, which was proposed in March 2018, and the draft Special Law on Sharing Economy Stimulation that has not been proposed yet, are introduced and evaluated. The Sharing Economy Basic Law Bill, which contains the basic contents of a sharing economy, is a faithful bill that contains core issues to be addressed in a sharing economy, except for a few partial problems. The bill uses especially the concept of 'supplier' and 'user' rather than the concept of business and consumer considering the fact that the supply and demand of the sharing economy are mainly peers. In addition, the supplier is divided into the 'regular supplier' and the 'temporary supplier' because the business and the peers are mixed in the market and the differentiation is important in relation to the application of law. In addition, the bill establishes an intermediary provider designation system for the regulation of large-scale platforms, in which platform operators design a self-regulatory model and take a co-regulatory approach guided by administrative authorities. In the case of sharing economic regulations, it is reasonable that minimum entry requirements and imposition of duty should be regulated by law, and others should be lead by self-regulation. Specifically, it seems necessary to establish a common regulatory model in which regulators are appropriately involved in the compliance of the self-regulation model of the business for the performance of obligations. In this perspective, the Sharing Economy Basic Law Bill provides unlike the draft Special Law on Sharing Economy Stimulation a good example of the appropriate regulation direction of the sharing economy.
