Abstract

Citizens have become more aware of their rights in recent times. Citizens are actively claiming their rights along with the growing mood in the society where an assistance from legal professionals is readily available in case of any administrative measures which directly or indirectly invading, or appears to be invading with their rights. Due to this phenomenon, administrative litigations are continuing to rise in volume. This research is to examine the characteristics of an administrative litigation in Seoul, one of the local governments. By drawing and improving, any problems arose in relation to administrative litigation affairs, it may prevent a possible litigation at a pre-litigation stage. The objective of the research is to decrease the percentage of the lost cases while in a litigation. In the case of local government, it should form a general consensus with citizens during the process of reinforcing its business project and while making a sufficient review on the legal issues prior to any administrative measures being imposed. With active participation in the administration by citizens, local government must have instill a sense of trust in its citizens. this will eventually reduce the administrative litigations and will be able to save costs incurred from a stop of gigantic city-wide project or litigations thereby bring the administration one step above.
