해양바이오산업 육성 및 지원을 위한 법제 개선방안 연구: 지역 거점화 정책과 관련하여

지구상에 서식하는 생명종 중 해양생명종은 약 80~90%를 차지하고 하다. 아직 해양생명종의 산업적 활용사례는 1% 미만이지만 그만큼 미래 확장 잠재력이 매우 높은 분야이다. 현재 전세계적으로 바이오 분야에 대한 기대와 투자와 높아지고 있는 가운데, 우리나라에서도 세계적인 바이오 기술 선진국으로 도약한다는 목표 하에 해양바이오산업을 신성장산업으로 육성하기 위한 정책을 수립･추진하고 있다. 다만, 해양바이오 국가 정책을 실현하고 행정 기능을 향상시킬 수 있는 법률적 측면의 고려는 아직 미흡한 것으로 보인다. 아직 해양바이오산업 정책의 법적 근거는 모호한 편이며, 4대 권역별 해양바이오 거점화 정책에 대한 근거규정을 포함하여 해양바이오 기술개발, 사업화, 상용화 등의 산업의 전주기적 관리를 위한 규정이 마련되지 못하였다. 해양수산부는 2022년 해양바이오 신성장 전략을 수립하면서 해양바이오산업의 체계적 육성과 기업지원확대 등을 위해 「해양생명자원법」을 개정할 예정이라고 밝혔다. 그동안 추진해온 해양바이오 육성 정책이 법적 근거를 확보할 것이라는 점은 매우 긍정적이지만, 「해양생명자원법」이 해양생명‘자원’의 확보와 관리, 이용을 위한 것임을 고려할 때 해양바이오‘산업’의 육성 규정을 「해양생명자원법」에 마련하는 것이 적절한지 또는 법체계상 「해양생명자원법」에 ‘지역 거점화’ 등을 포함한 해양바이오산업 육성을 위한 다양한 수단을 구체적으로 반영할 수 있을지 우려가 발생할 수 있다. 따라서 본 논문은 현행 해양바이오산업 정책과 관련한 법률의 한계점을 검토하고, 지역 거점화 정책을 중심으로 해양바이오산업 육성 정책을 실현하기 위한 법제도적 개선방안을 제시하였다.
Abstract
Marine species account for about 80 to 90% of the species living on Earth. Since there has been less than 1% of industrial use cases, the potential for future expansion is considered significantly high. The Korean government is establishing and promoting policies to foster the marine bio-industry as a new growth industrial area. Nevertheless, the legal consideration to support the national policy on the marine bio-industry seems insufficient. The legal basis for marine bio-industry policies is still ambiguous, and regulations for the life-cycle management of the industries have yet to be established, especially regarding the regional clusters for the bio-industry. The Ministry of Oceans and Fisheries (MOF) announced it would revise the ‘Act on Securing, Management, and Use of Marine and Fisheries Bio-resources (Act on Marine Bio-resources)’ to systematically foster the marine bio-industry and expand support to corporate. It could be positive that the marine bio policy has a legal basis. However, considering that the Act on Marine Bio-resources aims to secure, manage, and use marine living “resources”, it could be inappropriate to reflect various means to foster marine “bio-industry”. Therefore, this paper examines the limitations of the current laws related to the marine bio-industry and suggests legal and institutional improvements to foster the marine bio-industry by focusing on policy on regional clusters for the bio-industry.
