A Study on reasonable policy of the Victim's right in Criminal procedure

초록
Through the amendment of the Code of Criminal Procedures in 2007, various provisions that are aimed at protecting the rights of criminal victims throughout trial procedures have indeed been realized. As a matter of fact, numerous former devices protecting the victims of specific types of crime have now come to be more broadly applied, some of them lately being recognised as new rights of criminal victims. It seems reasonable that institutional devices to protect the victims of crime -for instance, the right to be notified of the course of criminal procedure, or the right to sit in company with persons in relation of mutual trust- have currently been prescribed within the Code of Criminal Procedures, which enables them to be applicable to victims of all cases. Nevertheless, there ought to be limit to such devices, for they cannot be extended limitlessly no matter how necessary they may be. Since these devices might infringe the right of the accused and may fall in danger of stigmatization, the court should always keep eye on the abuse of numerous institutional devices that are aimed at protecting criminal victims.
