반세기에 가까운 지방의회 역사에도 불구하고 여전히 그 위상과 권한은 미약한 수준에 불과하다. 그동안 지방자치법의 틀 내에서 지방의회를 강화하기 위한 법 개정 작업이 꾸준히 이뤄졌지만 이러한 상황은 획기적으로 개선되지 못하고 있다. 따라서 이제 지방자치법이라는 틀 자체의 한계를 인정하고 새로운 방향으로의 전환을 진지하게 모색해봐야 하는 시점이다. 본 연구는 이러한 문제의식 하에 지방의회의 권한과 조직·운영을 별도로 규정하는 단독 법률로서 ‘지방의회법’ 제정의 필요성을 제시하고, 법안 내용의 주요 방향성을 논하는 데 목적이 있다. 이에 따라 본 논문에서는 그동안 국회에서 발의된 지방의회법안들을 분석한 후 독립성, 전문성, 책임성을 중심으로 지방의회법의 제정 방향을 제안하였으며, 나아가 지방의회를 규율하는 법체계의 전반적인 재구조화를 도모했다. 한 마디로, 지방의회법은 지방자치의 양대 축인 지방의회와 집행기관(단체장) 간 견제와 균형을 위한 최소한의 제도적 장치로 규정할 수 있다. 따라서 지방의회법 제정을 통해 지방의회가 지방자치 발전을 위한 새로운 가능성의 공간으로 거듭나도록 해야 한다.
Abstract
Despite the nearly half-century of local councils' history, their status and authority remain minimal. While ongoing efforts to strengthen local councils within the framework of the Local Autonomy Act have been made, this situation has not significantly improved. Therefore, it is time to acknowledge the limitations of the Local Autonomy Act itself and seriously explore a new direction. This study, with this critical awareness, proposes the necessity of enacting a “Local Council Act” as a standalone law that separately regulates the authority, organization, and operation of local councils, and discusses the key directions for its content. Accordingly, this paper analyzes local council bills proposed in the National Assembly and proposes a direction for enacting the Local Council Act, focusing on independence, expertise, and accountability. Furthermore, it seeks to comprehensively restructure the legal framework governing local councils. In short, the Local Council Act can be defined as the minimum institutional mechanism for checks and balances between the local council and the executive branch (government head), the two pillars of local autonomy. Therefore, through the enactment of the Local Council Act, local councils should be reborn as a space of new possibilities for the development of local autonomy.
