간여시계열에 의한 성범죄 예방 정책의 효과분석: 전자감시제도의 성범죄 일반예방효과를 중심으로

본 논문은 최근 사회적으로 큰 문제가 되고 있는 성범죄의 심각성을 인식하고 서울시를 분석대상으로 하여 간여 시계열을 통하여 전자감시제도의 정책 개입 효과를 분석하였다. 특히 본 논문에서는 전자감시제도의 성범죄 일반예방효과 분석에 초점을 맞추었기 때문에 공식데이터인 성범죄 발생건수와 성범죄 동종 재범율을 이용하였다. 분석 결과, 전자감시제도의 개입은 크진 않지만 영구적 • 단계적으로 약간의 성범죄 예방 효과가 있는 것으로 나타났다. 이는 전자감시제도의 대상이 성범죄를 저질렀던 사람 중 재범의 우려가 있는 사람에게만 국한되므로, 실질적인 통제를 느낄 수 없는 잠재적 성범죄자들에게는 성범죄로 인한 처벌에 대해 큰 경각심을 주지 못한 것으로 해석된다. 본 연구의 결과는 전자감시제도를 시행함에 있어 감시대상의 범위를 더욱 확대 적용하여 성범죄 처벌에 대한 경각심을 더욱 높여야할 필요성을 제기해 주고 있다. 아울러 전자장치 부착 대상을 확대함에 있어 재범위험성의 판단은 검사나 법원의 영역에만 국한된 것이 아닌, 심리학 혹은 정신의학 등의 전문가 진단까지 함께 고려하여 전자창치 부착명령의 요건으로 할 필요성이 있음을 정책적 함의로 제시하였다.
Abstract
The purpose of this study is to analysis general deterrence effect of Sexual crime of electronic monitoring system. For it, an official data related to the number of sexual crime and recidivism rate of the same kind of sexual crime was collected and it was analyzed by the intervention time-series. The analysis showed that electronic monitoring system has an some effect on sexual crime prevention according to a result of intervention time-series analysis. Through the analysis result, this study is suggest that there are the need to extend the scope of the application of electronic monitoring system in order to alert the potential sex offenders to attention of the punishment.
