2017년의 신고리 5・6호기 공론조사는 무작위 추첨과 숙의 과정을 내용으로 하는 추첨형 시민조직의 의미 있는 사례이다. 민주주의 원리에 부합하지 못한다는 측면에서 심각한 한계에 봉착하고 있는 선거형 대의제는 소셜미디어의 급속한 발달로 인해 그 쇠락이 가속화되고 있다. 이런 상황에서 추첨형 시민조직이 선거형 대의기구인 의회의 대안으로 모색되는 것은 매우 고무적인 일이다. 아테네 민주주의의 핵심이었던 추첨형 대의제는 자기 지배의 실현을 위한 조직으로서 여러 가지 측면에서 선거형 대의제보다 우월한 가치를 보유하고 있다. 추첨형 대의제의 확산을 위해서는 그 핵심인 추첨절차와 숙의절차에 관한 치밀한 논의가 필요하다. 선거 의회와 병렬적으로 운영되는 것을 넘어서 추첨 의회가 독자적 입법기구로 구성된다면 민주주의적 권력분립으로의 전진이라고 할 수 있다.
Abstract
The public opinion poll on the Shin Kori-5 and Shin Kori-6 nuclear power reactors in 2017 is a sort of public participation that is composed of random selection and deliberative process. The representation by election is increasingly contradictory to the Principle of Democracy especially because of the rapid development of social media. So, it is very encouraging that a public deliberative body by sortition rather than election is sought as an alternative to the electoral parliament. The representation by sortition, the key Athenian democratic principle, is superior to electoral representation in terms of realizing the Principle of Identity. The form of government in which the lottery council performs all or part of the legislative functions on behalf of the electoral parliament is an advanced form of democratic government.
