영국 헌정사에 있어서 레퍼렌덤의 특징과 의의

초록

레퍼렌덤은 한 국가의 모든 국민들이 헌법적 중대 사안을 놓고 투표할 수 있는 기회를 뜻한다. 레퍼렌덤이 의미를 지니는 이유는 대의민주제가 제대로 기능을 발휘하기 어려운 헌법적 위기의 순간에 그 진가를 드러내 보이기 때문이다. 근래에 대한민국 국민들이 체험했던 대통령에 대한 ‘탄핵심판’ 과정과 같은 헌정사적 비극은 대의민주제의 한계를 적나라하게 보여주었다고 해도 과언이 아니다. 비록 영국인들이 ‘의회주권의 원리’를 자신들이 고수해 온 의회민주주의 전통의 불가변의 진리로 떠받들고 있음에도 불구하고, 1920년을 기점으로 영국 헌정은 일련의 레퍼렌덤을 꾸준하게 경험해 왔다. 영국인들이 겪었던 레퍼렌덤의 주제는 도덕적인 이슈부터 분권의 권략이양에 이르기까지 실로 다양한 주제에 걸쳐있다. 비록 영국 헌정에 단일하고 축약된 성문헌법전이 존재하지는 않지만, 영국 국민들은 자신들이 경험해 온 레퍼렌덤이야말로 중대한 헌법적 사안 앞에서 자신들의 최종적인 의사를 적절하게 표현할 수 있는 훌륭한 직접민주제의 도구라는 사실을 인정하게 되었다. 이제 레퍼렌덤이 영국 헌정을 관통하는 하나의 ‘헌법적 관행’으로 자리 잡게 되었다는 사실에 대하여 의문을 제기하기는 어렵게 되었다. 영국 헌정과 레퍼렌덤의 경험이 우리에게 던져주는 가장 큰 시사점은 국민투표 관련 조항인 현행 헌법 제72조의 개정이 절실하게 요청된다는 사실이다.

Abstract

Referendum is an occasion when all the people of a country can vote on an important issue. Its value is particularly significant when representative democracy can not properly function over the critical constitutional issues. Recent Korean constitutional crisis triumphantly shows us the limitations of representative democracy in terms of effective countermeasures for constitutional catastrophe such as impeachment proceedings. Although parliamentary sovereignty is considered as the invariable principle of the Westminster parliamentary democracy, UK’s Constitution has experienced a series of referendums since 1920. Is is remarkable that the theme of referendum varies from moral issues to devolution. Although there in no codified constitution in the UK, a referendum is being taken into account as an effective tool of direct democracy in which common people can freely express their ultimate answer to the contested constitutional issues. There is no doubt that referendums have become one of the solid constitutional conventions in the UK’s Constitutional Experience. UK’s exemplary case demonstrates that the amendment on the referendum provision-Article 72 of the Korean Constitution-needs to be considered in all seriousness.
