통일에 대비한 지식재산권 기반조성전략: 북한의 산업재산권 법제 인프라에 대한 이해중심

Abstract

For the formation of a single unified “information society” on the Korean Peninsula, we should make mutual recognition and protection of intellectual property rights(IPR) possible and establish a common legal framework to realize IPR between the South and the North. Furthermore, we should conduct South-North Korean exchanges and cooperation continuously in the field of IPR. Some proposals can be suggested as concrete ideas of inter-Korean IPR’s exchanges from the legal or practical perspective. First, it is desirable that the two Koreas should adopt a charter for the construction of Korean National Information or IPR Community. Second, the two Koreas should initiate and develop not only inter-Korean human contacts but also technical or material cooperation in the IPR's area. Third, the two Koreas should also permit and expand direct communication and on-line trade by internet between the South and the North as a way of laying a foundation for Korean National Information Community. Fourth, the two Koreas should conclude inter-Korean agreements concerning mutual respect and protection of IPR. By dint of such agreements, each side must fully protect and enforce IPR owned by people of the other side.
