국제연합 사회권위원회와 인권이사회를 통한 주거권 보장

초록

국제사회에서는 1948년 세계인권선언에서 처음으로 적절한 주거권이 권리로 인정되었다. 1966년 경제적·사회적·문화적 권리에 관한 국제규약(International Covenant on Economic, Social and Cultural Rights) 제11조에서는 적절한 주거권을 규정하고 있다. 경제적·사회적·문화적 권리위원회(Committee on Economic, Social and Cultural Rights)는 사회권규약을 실현하기 위한 기구이다. 사회권위원회는 주거권과 관련한 일반논평 4호(General Comment No. 4: The Right to Adequate Housing)와 일반논평 7호(General Comment No. 7: forced evictions)를 발표했다. 사회권위원회는 지금까지 4차례에 걸쳐서 최종 권고문(Concluding Observations)에서 우리나라의 주거권 보장의 미흡사항에 관한 개선을 권고하였다. 사회권위원회는 사회권규약 선택의정서(Optional Protocol of the International Covenant on Economic, Social and Cultural Rights)에 따른 개인청원(Communications Procedure)을 통한 방법으로 주거권을 보장하고 있다. 국제연합 인권이사회(Human Rights Council)는 보편적 정례검토(Universal Periodic Review)와 특별보고관(Special rapporteur)제도를 운영하고 있다. 보편적 정례검토에서는 우리나라의 주거권 보장을 위한 공공임대주택의 공급과 주거급여의 대상을 늘려서 주거지원필요계층을 배려할 것을 권고하는 내용이 포함되어 있다. 또한 2018년 주거권 특별보고관(Special Rapporteur on adequate housing)이 우리나라에 방문했으며, 2019년 주거권 특별보고관은 우리나라의 주거권 실태에 관한 보고서를 인권이사회에 제출하였다. 이 글에서는 국제연합 사회권위원회와 인권이사회를 통한 주거권 보장방안을 다루고자 한다.

Abstract

This article seeks to explore the ensuring the right to adequate housing through the UN committee on Economic, Social and Cultural Rights(ESCR) and Human Rights Council. The right to adequate housing was recognized for the first time at the international level in the 1948 Universal Declaration of Human Rights. In 1966 United Nations member states adopted the International Covenant on Economic, Social and Cultural Rights, in which they recognized the right to Adequate housing. The Committee on Economic, Social and Cultural Rights is the body of independent experts that monitors implementation of the International Covenant on Economic, Social and Cultural Rights by its States parties. The Committee to carry out the monitoring functions assigned to the housings rights. ESCR had considered the periodic report of the Republic of Korea on the housing rights. Decides that the Human Rights Council shall be responsible for promoting universal respect for the protection of all human rights and fundamental freedoms for all. Undertake a universal periodic review, based on objective and reliable information, of the realization by each State of its housing rights obligations and commitments in a manner. Human Rights Council recommended the government had increased the number of public housing and public housing benefits to provide support to persons from vulnerable groups. and United Nations special rapporteur is titles given to individuals working on behalf of the United Nations within the scope of “special procedure” mechanisms who have a specific country or thematic mandate from the United Nations Human Rights Council. Special Rapporteur is independent experts appointed by the Human Rights Council to monitor specific rights. UN Special Rapporteur on adequate housing paid an official visit to the Republic of Korea in 2018. The Special Rapporteur’s report on the outcome of the visit and recommendations submitted to the UN Human Rights Council in 2019.
