韓 ·中 海事訴訟節次法上 積荷押留制度에 관한 比較法的 考察
A Comparative Study on Legal Systems concerning Arrest of Cargoes between the Korean and Chinese Maritime Laws

Abstract
This article is relating to legal systems concerning arrest of cargoes between the Korean and Chinese maritime laws. The Special Maritime Procedure Law will push the development of Chinese maritime transport and the international trade and economy. In this article, It is required to compare Chinese legal system for securing the maritime claims with Special Maritime Procedure Law of the People's Republic of China, and with Korea Civil Procedure Act as to the arrest of cargoes. This article comparatively described the arrest of cargo, mainly about the definition, the conditions for arrest of cargo and its legal consequence. Among those legal aspects, what needs emphasize is that only cargoes owned by the claim are detainable and the value of the cargoes detained should amount to the value of claims. Otherwise, the claimant is liable to the legal consequence arising from his misrepresentation.
