본 연구는 독일의 외부지역 관리의 특성에 대하여 연구하였다. 독일의 행정구역은 도시계획 체계상 계획지역, 내부지역, 그리고 외부지역으로 구분한다. 계획지역은 지구상세계획을 수립해야 하는 지역이며, 내부지역은 기존 시가지가 있는 지역으로 지구상세계획을 수립하지 않아도 되는 지역이다. 외부지역은 그 이외의 지역으로 사실상 우리의 그린벨트와 비슷한 역할을 하는 지역이다. 독일에는 개발제한구역이라는 용어가 없지만 독일의 국토계획 관리상 외부지역(Aussenbereich)을 의미한다. 독일 외부지역은개발규제의 관점에서 두 가지로 구분된다. 하나는 특전적 개발행위 규제이고 다른 하나는 비특전적 개발행위 규제이다. 비특전적 개발행위는 선취적 배려 개발행위 규제와 기타 개발행위 규제로 구분된다. 특전적 개발행위 규제는 생업을 위한 개발행위의 규제이며, 선취적 배려 개발행위 규제는 기존 거주자들의필요에 따른 개발행위 규제를 의미한다. 이 두 개발행위 규제는 상당히 완화되어 가는 경향이 있다. 이와반대로 기타 개발행위 규제는 상당히 엄격하여, 기존의 기반시설과 연동하여 규제하고 있다.
Abstract
This study aims to identify the characteristics of development control in German Green Belt. Actually there is no authorized Green Belt in German Act. It is called “Grün Gürtel” in English green belt. There are three areas in the administrative area. The first is Plan-area(Planbereich) in which B-Plan should be planned for development, the second is Inner-area(Innenbereich) which is existing built-up area. And the other area is called outer-area(Aussenbereich) which is conceptual green belt. In the Aussenbereich, two categories is identified for development control. The one is privilege development, the other non-privilege development control which is categorized two control (exceptional development control and the other development control). The privilege development control is for the development for livelihood, the exceptional development for existing houses and the other development control for limiting development with optimal infra-structure.
