초록

Abstract

헌법상 사회보장권이란 사회적 위험으로 말미암아 요보호상태에 있는 국 민이 인간의 존엄에 상응한 인간다운 생활을 영위하기 위하여 국가에 대해 일정한 내용의 적극적 급부를 요구할 수 있는 권리를 의미한다. 그리고 사 회보장기본법상 사회보장권이란 사회보험, 사회보상, 공공부조, 사회복지를 받을 권리를 의미한다. 그리고 사회보장기본법에 의하면 사회보험이란 경제 적 약자에게 인간다운 생활을 위협받을 정도의 질병, 사망 기타 상당한 재 산상 부담이 되는 사고가 발생한 경우에, 그 위험부담을 국가적인 보험기술 을 통하여 다수인에게 분산시킴으로써, 경제적 약자의 인간다운 생활을 사 회보장적 작용을 의미하여, 그 유형은 의료보험, 연금보험, 재해보상보험, 실 업보험청구권, 노인장기요양보험 등으로 분류된다. 본 논문에서는 사회보험 중에 노인장기요양보험을 중심으로 본 논문을 전개하고자 한다. 사회복지를 받을 권리는 금전적 급여를 통한 최저한도의 생활보장과 자립 을 목적으로 하는 국민기초생활보장과 비금전적 급여를 통한 재활, 생활의 안정과 복지의 증진을 목적으로 하는 사회복지서비스에 대한 통합적인 급여 청구권을 말한다. 이에 대한 우리 헌법은 인간다운 생활의 보장방법의 일환 으로 헌법 제34조 제2항에서 국가가 사회보장 사회복지의 증진에 노력할 의무를 규정하고 있다. 2008년 7월 1일부터 노인장기요양보험제도가 실시되고 있다. 중풍, 치매 등으로 고생하고 있던 노인 중에서 약 15만 명 정도가 지금 이 제도에 따라 장기요양서비스 혜택을 입고 있다. 이렇게 시작된 노인장기요양보험제도는 매우 중요한 의의를 지니고 있다. 다가오는 고령사회에서 노인인구가 증가 하면서 장기요양보호를 필요로 하는 노인이 크게 증가할 것으로 예견되고 있는 상황에서 이 제도의 실시는 고령사회의 노인문제에 적극적으로 대응하 는 계기가 될 것으로 보고 있다. 이러한 취지에서 본 논문에서는 우선 노인장기요양보험의 법적 근거인 헌 법적 근거를 먼저 살펴보고, 막 시작한 우리 나라의 노인장기요약보험을 알 아보기 전에 각국의 노인장기요양보험을 살펴보고, 이를 중심으로 한국의 노인장기요양보험제도에 대하여 논의하고, 이에 대한 개선점을 논의하고자 한다.
