이 글은 독일에서 최근 시행된 전문인력이주법의 내용과 시사점을 살펴본다. 독일 정부는 비숙련노동자에 대한 높은 문턱을 유지하면서 고급인력에 대해서는 지속적으로 입국 및 고용 조건을 완화하는 조치를 취해왔다. 최근 시행된 전문인력이주법은 이러한 기조를 유지하면서도 전문인력에게 문호를 넓힌 법제로, 2018~2019년 독일에서 제정된 법률 가운데 매우 중요한 법으로 평가받는다. 기존 독일의 이주정책이 대학졸업자와 고급인력에 집중되었다면, 이법은 직업교육을 받은 숙련기술자에게도 독일 체류 및 노동시장 접근의 문을확대하고자 했다. 주요 개정사항은 다음과 같다. 첫째, 대학졸업자가 아니더라도 전문인력이 독일 노동시장에 접근할 수 있는 가능성이 커졌다. 둘째, 공인된 자격이 있을 경우 취업우선권심사가 면제된다. 셋째, 지금까지는 인증된 전문인력만이 최대 6개월간 독일에 체류할 수 있었으나, 전문인력에게도 근로계약 없이 체류할 수 있는 가능성이 열렸다. 넷째, 직업교육을 받은 전문인력의영주권 취득 요건이 완화되었다. 다섯째, 전문인력의 체류허가 취득 절차가 신속하게 진행될 수 있게 되었다. 마지막으로, 24세 이하 외국인이 직업훈련원을찾기 위해 독일에 체류할 수 있게 되었다. 전문인력이주법 제정을 통해 제3국의 전문인력이 독일 노동시장에 접근할 수 있는 통로가 확대된 것은 분명하다. 전문가들은 큰 틀에서 그 방향성에 대해 동의하나, 관련 법규정과 절차가여전히 복잡하며 더 개선되어야 한다는 지적도 있다.
Abstract
This study aims to see the Fachkräfteeinwanderungsgesetz (FEG) which came intoforce on March 1 2020 in Germany. German government tried to attract highlyqualified foreign workers with eased conditions for entry and employment whilemaintaining “raising the doorsill” to low skilled workers. The FEG, regarded as one ofthe most important legislation 2018/2019, is the legislation sticking to this key noteand opening the door to the specialists from the third countries. While the existinglegislation concentrates on college graduates and highly qualified labor, the newlegislation aims to ease the residence and employment conditions for professionals withvocational training. The main amendments are as follows: firstly, professionals who arenot college graduates can have better opportunity of access to labor market; secondly,qualified professionals are exempt from the Priority Check (Vorrangprüfung); thirdly,professionals - previously, only qualified professionals may reside in the country for upto 6 months- may temporarily reside in Germany without labor contract; fourthly, theconditions for permanent residency for professionals with vocational training arealleviated; fifthly, professionals can enjoy the fast-track procedure for residence permit;finally, a foreigner under the age of 24 may reside in Germany to look for anapprenticeship (Ausbildungsplatz). Under the regulations of the FEG, third-countrynationals seem to have better access to the German labor market. However, somecriticize that the provisions and the procedures are still complicated.
