한국문학에 표현된 법의식 -근대 및 현대소설에서의 표현을 중심으로-

Abstract
Generally speaking, legal thoughts and legal responses are differently expressed in every nation. So, it might be very important to studying the differences between the legal cultures and legal awareness of other countries. Literature reflects the world-view of the ages as well as the author's idea. In sociology, therefore, the research on the portrait of society which is depicted in the literature are very common. In this paper, the author explores legal awareness of Korean literature especially modern Korean novels, and introduces three results as below. The first, in Korean literature, morals and ethics are more important than legislation. The second, legal awareness in Korean literature based on the natural law theory not on the legal positivism. These tendency could be called as the literary natural law theory. The third, legal awareness in Korean literature shows Koreans prefer non-legal dispute settlement rather than legal procedure.
