中国是世界上第一个提出 “生态文明”的国家, 目前已经把 “生态文明”写入 ≪宪法≫和 ≪民法典≫ ≪环境保护法≫等法律中, 但尚未制定针对生态文明建设的专项立法。立足于中国生态文明建设实践和发展需求, 总结地方生态文明建设立法经验, 制定专门性生态文明建设法律具有重要意义。生态文明建设法应该定位为一部激励型立法, 其立法目的是保障生态利益、促进生态文明建设的顺利进行。生态文明建设的内容极其广泛, 生态文明立法难以面面俱到, 可以按照规划先行、保护优先、经济发展、文化培养、制度保障、责任底线的逻辑思路, 确定核心内容。
Abstract
China is the first country in the world to propose “ecological civilization.” At present, “ecological civilization” is explicitly stated in the Chinese Constitution Law, Civil Act, Environmental Protection Law, etc. However, there is no special law has been enacted to target the development of ecological civilization. Based on practice and development needs of China's ecological civilization development, it is of great significance to synthesize local ecological civilization development legislative experience and enact specialized Ecological Civilization Development Law. The Ecological Civilization Development Law should be positioned as an incentive legislation, and its legislative purpose is to protect ecological interests and promote the smooth progress of ecological civilization construction. The content of ecological civilization development is very broad, and it is difficult for Ecological Civilization Development Law to cover everything. However, the core content can be determined based on logical thinking such as priority of planning, priority of protection, economic development, cultural cultivation, institutional guarantee, and net benefit of responsibility.
