본 논문은 사전의료지시서의 입법에 관한 오스트리아와 독일 및 국내의 논의를 검토하고, 사전의료지시서의 입법에 관한 의견을 개진하는 것을 목적으로 하였다. 오스트리아의 경우 사전의료지시서에 관한 특별법에서 이러한 내용을 규정하고 있으며, 독일의 경우 민법의 성년후견제도에서 그것을 규정하고 있다. 우리의 경우 현재 국회에 이와 관련한 2개의 입법안이 제출되어 있고, 대한의사협회 등의 연명 치료 중단에 관한 지침이 존재하는 한편, 2009년 대법원 판례가 연명 치료 중단에 관한 기준을 제시하고 있다. 사전의료지시서에 관한 입법은 성년후견과 관련하여 이루어지는 것이 바람직하며, 사전의료지시서의 요건을 엄격하게 규정하고 그에 따라 사전의료지시서의 구속력을 인정하여야 할 것이다.
Abstract
This paper is aimed at considering of legal discussion in Austria and Germany and developing an argument concerned with legistration of living will. In Austria living will is provided in the special law on living will and in Germany it is provided in the civil law on guardianship. In korea two bills were presented to the National Assembly. The korea medical association has set up a guidline for remove the artificial respirator. And according to a decision on the remove of life-sustaining treatments the Korea Supreme Court(2009 da 17417) the withdrawal of life-sustaining tratments could be permitted by the subjective condition and by the objective condition. It is appropriate to introduce living will under the civil law on guardianship. For this, the provisions of the law on tighter living will requirements are essential. If a living does meet these requirements, the living will shall be legally binding.
