종합적 사이버보안 법률 제정에 관한 시론적 연구: 미국의 입법동향을 중심으로

오늘날 사이버보안 강화에 필요한 법제도의 정비가 시급히 요구되고 있으며, 통일된 추진체계를 구성하고 사이버보안을 전체적으로 강화하는 종합적 사이버보안 법률의 제정이 중요한 과제가 되었다. 미국은 의회에서 사이버보안에 대한 위협의 심각성을 공화당과 민주당 모두 공동으로 인식하고 있으나 세부적인 내용에서는 아직 최종적인 합의에 이르지 못하였다. 그러나 입법활동은 지속적으로 진행되고 있으며 의회에서의 논의도 상당히 활발하였다. 그리고 그러한 일련의 과정을 바탕으로 하여 최근에는 의회에서 의견의 합의가 도출될 징후도 나타나고 있다. 이에 비하여 한국에서는 관련 법안의 논의가 거의 이루어지지 않고 있는 실정이다. 향후 한국에서도 종합적 사이버보안 법률 제정에 대한 논의를 활발히 진행할 필요가 있다.
Abstract
Today, the improvement of legal system in cybersecurity is a very important task. The legislation of comprehensive Cybersecurity Act is required for the establishment of unified governance system and the total enhancement of cybersecurity in particular. All of the lawmakers of United States Congress recognize the seriousness of threats in cyberspace. Both Republicans and Democrats have critical mind in cybersecurity. On the other hand, not only the details of new Cybersecurity Acts are different between Republicans and Democrats, but also they have not reached the final agreement on the legislation of Cybersecurity Act. However, the legislative actions have been ongoing, and the discussions in United States Congress have been very active as compared with the ones in the National Assembly of Republic of Korea. Moreover, there seems to be the signs of consensus of opinion in the United States Congress based on such series of steps recently. Unlike the United States, there are very few discussions regarding cybersecurity legislation in the National Assembly of Republic of Korea. Hence, active discussions regarding enactment of comprehensive Cybersecurity Act are necessary.
