Abstract
From the viewpoint of some basic principles of competition law, it is hard to understand the Art. 5 (5) (i) of the Presidential Decree concerning the Art. 3-2 (1) (v) of Korean Antitrust Regulation and Fair Trade Act (“MRA”) which prohibits the exclusion of competitors by the so-called the unilateral below-normal transaction pricing practice’(“BNP”) as one type of abuse of dominant position. However, there is no workable and concrete meaning of BNP in the context of trade between dominant firm and its customers. Because it is not possible to find out BNP in any relevant market, Article 5 (5) (i) of the Presidential Decree is neither workable for the purpose of the Art. 3-2 (1) of MRA. For this reason, it is desirable to repeal Article 5 (5) (i) of the Presidential Decree which contain the BNP test. On February 2015, the Korean Fair Trade Commission firstly decided that two mobile telecommunication firms violated the Art. 5 (5) (i) of the Presidential Decree. After analysing the decision of KFTC, this article reached the conclusion: (i) there is no evidence showing that each of the firms has dominant position; (ii) there is no evidence showing that the prices between each of the firms and its own customers are the so-called BNP; (iii) there is no evidence showing that each of two firms’ competitors are excluded from the relevant market; therefore, (iv) the decision of KFTC shall be vacated by the courts.
